Loan Agreements

Loan Agreements are made between a Lender and a Borrower.  It is important that a loan is correctly documented to outline such information as, the sum borrowed, the term of the loan, interest rates, repayment dates and whether the loan is to be secured against property.

Commercial & Residential Mortgages

It is prudent to have security for monies loaned to borrowers.  Together with a Loan Agreement, the best form of security is a mortgage registered against the real property of the borrower. 

In the event that there is already a mortgage registered against the borrower’s property, the first mortgagee will require a Priority Document.

Personal Property Securities Register

A loan can also be secured over personal property of a Borrower (eg, vehicles, equipment).

The PPSR is a noticeboard only, it flags that a secured party is claiming a security interest against the personal property of a grantor.  It is not a registration of actual documents, neither is it a register of title.

You can place a notice on the PPSR to show that you have enforcement rights over personal property.

Bank Guarantee Documentation Advice
